1What this document covers
This explains the messages Nefense Professional Corporation may send you, by email and by text message, what you have agreed to receive, and how to stop any of it.
How we handle the contact details themselves, including how long we keep them, is in the Privacy Policy. This document is about the messages.
2Two different kinds of message
Almost everything turns on this distinction, so it comes first.
- A message about something you did
- A confirmation of an order you placed, a shipping or delivery update, a return or refund update, a receipt, a notice before a repeat order renews, a sign-in or password message, an answer to a question you asked us, or a safety or recall notice about something you bought. These are part of the thing you asked us to do, and they are sent because you did it.
- A marketing message
- Anything whose purpose is to sell you something or bring you back: a new product, an offer, a reminder about a bag you left behind, product education written to promote us, or an invitation to review something you bought. If the point of the message is us rather than you, we treat it as marketing, and the rules in this document for marketing apply to it.
Where a message is genuinely both, we treat it as marketing. That is the stricter rule and it is the one we hold ourselves to.
3Consent, and what is never conditional on it
You never have to agree to marketing messages in order to buy from us. Not to place an order, not to create an account, not to get a price, and not to get help.
Consent is separate for each kind of message and for each channel. Agreeing to marketing email is not agreeing to marketing texts. Giving us your number so we can tell you a delivery is late is not giving us your number for offers. Where we ask, we ask specifically, we say what you will get, and an empty box stays empty: we do not pre-check it for you.
If you buy from us and never agree to anything else, you will still get the messages about your order, because those are part of the order.
4Text messages: where things stand today
We do not send text messages. Not marketing, and not about your order.
If you have given us a phone number, it is there so a carrier can reach you about a delivery and so we can call you if something about your order needs sorting out. It is not on a marketing list, because there is no marketing text list.
If that changes, it changes by you opting in, not by us deciding your number was already ours to use. We will not treat a number you gave us for a delivery as permission to text you offers.
5Text messages: what a program would look like
So that you know what you would be agreeing to before you are ever asked, this is what we commit to if we start sending text messages.
- You opt in. You opt in yourself, on purpose, and the wording tells you what you are signing up for before you agree rather than after.
- You get a confirmation. The first message confirms what you signed up for, tells you roughly how often to expect one, and tells you how to stop.
- Message and data rates may apply. Your phone company may charge you for messages and for the data they use. That is between you and your carrier and it is not something we control or receive. Rates depend on your plan.
- STOP always works. Reply STOP to any message and we stop. Reply HELP and you get a plain answer telling you who we are and how to reach a person.
- Reasonable hours. We do not text at unreasonable hours, and we do not use a text message for anything urgent that we have no other way to tell you about.
6How to stop, and what stopping means
One request to stop covers every marketing message on that channel: every campaign, every list and every schedule, not only the one you replied to.
6.1 Email
You can stop marketing email at any time. If you have an account, turn it off in your notification settings. If you do not, write to support@nefense.com with the word Unsubscribe in the subject line and we will do it for you. Either one covers every campaign and every list, not only the message you replied to.
We are adding a one-click unsubscribe link to every marketing email. Until it is there, the two routes above are how you stop.
6.2 Text messages
If we ever send them, replying STOP to any of them stops all of them. So does writing to support@nefense.com with the phone number you want removed.
6.3 What stopping does not stop
Stopping marketing does not stop the messages about an order you have actually placed. You will still get a confirmation, a shipping update, a receipt, a refund update, and a safety or recall notice, because those exist to tell you what is happening with your own money and your own order.
If you want those to stop as well, tell us and we will talk it through with you, but we will not agree to have no way of reaching you about a problem with an order or about a product that turns out to be unsafe.
6.4 How quickly
We act on a stop request as soon as we receive it. A message that was already handed to a mail or messaging service before your request arrived may still land. If you get a marketing message more than a few days after you asked us to stop, tell us: that is a fault, not a policy, and we want to know about it.
We keep a record of when you asked for marketing messages and when you asked us to stop, so that a question about a message you did not want has an answer.
7Email in detail
7.1 What we send because you bought something
- Order confirmations and receipts.
- Shipping, delivery and delay updates.
- Return, replacement and refund updates.
- A notice before a repeat order renews, and a confirmation when one is canceled.
- Sign-in, password and account security messages.
- Answers to something you asked us.
- A safety notice or a recall about a product you bought.
7.2 What counts as marketing
- New products, offers and promotions.
- A reminder about a bag or an order you did not finish.
- Product education written to bring you back to us.
- An invitation to review something you bought.
We do not send marketing email to somebody who has not asked for it, and we do not buy lists of email addresses.
7.3 What is in every marketing email
Who it is from, a subject line that describes what is actually inside, a way to unsubscribe in one step, and our business address.
8A consent you give us is not consent for anybody else
Permission you give Nefense covers messages from Nefense. It never covers anyone else, and we do not treat it as if it did.
Nefense Professional Corporation is a separate company from Sleep Balance Academy PC. Buying from one is not buying from the other, and a phone number or an email address you give one of them is not permission for the other to message you. If you want messages from both, you sign up for both, separately.
We do not sell or rent your contact details to anybody who would message you, and we do not lend our list to a partner so that they can. Where a company sends a message on our behalf, it goes out as us, it says so, and stopping it stops it.
9Wrong number, wrong address, or a message you did not expect
- Tell us at support@nefense.com. Include the number or address that received the message.
- We stop sending to it. We will not ask you to prove who you are first, because somebody receiving a message meant for a stranger should not have to identify themselves to make it stop.
- If somebody put your details on an account that is not yours, tell us that too and we will look at the account rather than only at the message.
You are responsible for keeping your own contact details current with us. If your number moves to somebody else, tell us, because we have no way of knowing.
10Age
You must be at least 18 to sign up for messages from us, and you must be the person who is entitled to use the phone number or email address you give us.
11Changes to this document
We update this document when what we do changes, when the law changes, or when we find wording that is unclear. Every version is kept, and each one records the date it took effect.
How you find out depends on how much changed. A correction that does not change your rights is simply published. A change that does affect your rights is announced before it takes effect. A change that materially alters what you agreed to is not applied to you by silence: we ask you to accept it, and continuing to browse the site is not treated as acceptance.
If you want a copy of an earlier version, or want to know what changed and when, write to support@nefense.com and we will send it to you.
